General
ALL SALES ARE FINAL. NO RETURNS ARE ACCEPTED. Items are sold to the highest bidder.

The auction begins on April 29th, 2008 and ends 9:00 PM eastern standard time on Thursday, May 29th. Beginning at 9:00 PM EST, the 15-minute rule will be in effect: Bidding will continue to until no other phone/Internet bids are received for 15 minutes. This rule provides all bidders the opportunity to bid on the items without getting cheated due to any time constraints or last second bids. The auction will officially end when the website indicates “Historic Auctions Bidding Is Closed.”

Bidder Registration
All bidders must register with Historic Auctions, LLC by calling (727) 456-7171 or by visiting www.HistoricAuctions.com to be eligible to bid in the current auction. Once you obtain a Username and Password, you will be able to use it for all future auctions, unless you request a change. If you cannot remember your bidder number, username, password, or are not sure if you have an account with us, please email us at info@historicauctions.com or call (727) 456-7171. Certain items, at Historic Auctions sole discretion, may require additional credit approval and may require additional information to be submitted. Historic Auctions reserves the right to cancel an account or to reject an application for additional credit for any reason. If you have consigned items to us in the past, you are already registered. Please give us a call instead of creating a new account.

Auction Results
Full results of the auction will be available immediately following the close of the auction on our website at www.HistoricAuctions.com.

Bidding Policy
We accept telephone, fax, mail and Internet bids. We will not accept bids sent via e-mail. Bidding for an auction with Historic Auctions, LLC is accomplished by utilizing a proxy bidding system format. This format allows you to place a bid as high as you want while the computer places your bid only as high as you need to go. During the bidding process, the next bid must be at least 10% greater than the high bid up to $100,000.00. Bids placed on items with a current bid of $100,000.01 and higher must be 5% higher than the high bid. If you are the high bidder, the computer will automatically place bids for you up to your specified amount in increments according to the most recent bid. Example: You place a bid of $500 on an item that has a minimum bid of $125. The current bid is now $125 with you as the high bidder. Someone bids $200 on the item raising the item price. However, the computer automatically recognizes your high bid of $500 and automatically places a bid for you 10% higher than the person bidding against you. Your current bid would be $220 with you being the high bidder. This bidding format allows you to be away from your computer while the bidding continues.

There is a 15% Buyers Premium on all auctions. Example: If you were to win an auction for $200, your total cost would be $230, not including postage, handling, insurance, and any applicable taxes.

In no event will Historic Auctions, LLC liability to a purchaser exceed the purchase price actually paid for any auction. Historic Auctions, LLC reserves the right to accept or reject any and all bids by any bidder and execute any bid on our own behalf. Historic Auctions, LLC reserves the right to postpone or delay the auction, for a reasonable period of time, due to any significant, relevant event which, in the sole judgment of the auctioneer, makes it inadvisable to hold the auction as scheduled, without recourse from any bidder, consignor or prospective bidder.

The title to any auction remains with the consignor or Historic Auctions, LLC and shall not pass to the successful bidder until the auction is paid for in full.

Payment
We accept multiple forms of payment including wire transfers, credit cards, money orders and personal checks. Checks take up to 14 days to clear. Items can take up to 7-10 business days after funds have been collected before shipment occurs. Historic Auctions, LLC reserves the right to refuse credit card payments on any auction for any reason.

Florida State sales tax will be charged at a rate of 7% up to $5,000 and 6% on the amount above $5,000 on any purchases collected, delivered in, or shipped within the state of Florida unless the purchaser has provided Historic Auctions, LLC with a valid sales tax exemption certificate issued by the State of Florida.

Payment is due within 14 days of the date of the invoice. Invoices will be mailed on or before June 2nd, 2008, unless we receive payment for your invoice before that date. Any bidder, who has not paid in full, without having made prior arrangements for late payment, will have future bidding privileges completely revoked and Historic Auctions reserves the right to turn any unpaid invoice over to a third-party collection agency along with any and all information related to your account and invoice.

If a winning bidder does not honor his or her bid with payment in full per the auction rules, then it is agreed that Historic Auctions, LLC may, at its sole discretion, sell the given item(s) to an under-bidder, any other bidder, re-offer the given auction(s) in a future auction, or sell the item in any means determined by Historic Auctions, LLC. It is deemed that the original winning bidder is responsible for any losses incurred or service charges involved in the sale of said item(s), and that the non-paying winning bidder explicitly agrees to pay any and all reasonable legal fees incurred by Historic Auctions, LLC, in the collection of these losses and/or service charges from the non-paying winning bidder if necessary.

Bid Notifications Via E-mail
You will receive bid confirmations and outbid notifications via e-mail on every item for which you are bidding. During active bidding, you will receive notice on the screen and via e-mail as to if you are the high bidder or if you have been outbid, whichever the case may be. You will also receive emails detailing your bidding history for each item. Please be sure to set Spam folders to allow emails from historicauctions.com. Though they are sent immediately, due to the nature of the Internet, Historic Auctions, LLC cannot be held responsible for e-mails that do not arrive in a timely manner.

Errors and Omissions
Historic Auctions, LLC is not responsible for any errors or omissions including but not limited to print, website, phone conversations, stated or implied, bidding, and/or registration. In the event of an error, Historic Auctions, LLC will update the website and or print (if possible).

Item Authenticity
Historic Auctions, LLC takes great pride in the genuineness and quality of the autographs that are offered in our auctions. Our authentication standards for items offered are uncompromising, and reflect Historic Auctions’ full commitment to collector satisfaction. Historic Auctions, LLC rejects a number of items when these items are presented with evidence that is insufficient to verify the authenticity. We utilize the following third-party authentications, including but not limited to James Spence Authentication, PSA/DNA, Lou Lampson & Beckett. Please refer to our website for any updates or specific details regarding specific authenticity on any item.

There is great subjectivity in grading. Every effort is made to describe the condition of each auction item as it actually is. We do not accept items for any auction without careful scrutiny by not only ourselves, but also by leading authenticators. We cannot guarantee that every item described by us will in all cases receive exactly the same grade or even be accepted for grading by any third party grading service. No warranty, whether expressed or implied, is made with respect to any grade, condition, or other adjectival descriptions, which can and do vary, even among experts. Furthermore, we are not bound by the opinions of any authenticators, grading services, or “experts,” nor do the rules governing auctions held in any of the “trade papers” or magazines in which we may advertise hold precedence over the above listed rules. All measurements are approximate.

Since we only use major and respected authenticators and since every item clearly specifies what authentication the item has received, Historic Auctions, LLC cannot be held liable if an item is won in our auction and subsequently submitted to a different authenticator, who does not pass the item. If you do not feel comfortable with an item or its authenticity, please feel free to contact Historic Auctions, LLC for further information regarding the item. If you are still not satisfied, please do not bid on the item.
